Well, my tax accountant says he sees no reason why I don’t qualify. 🤷‍♂️


That's because being an exempt or non-exempt hourly employee under the FLSA has never been a tax issue and most tax accountants don't really know or have not gone down the rabbit hole far enough to see that UPS drivers are exempt employees under the FLSA, due to Motor Carrier Exemption, as stated in the law, and are thus ineligible for the no tax on OT. We are FLSA exempt employees.

And the law states for tax years 2025 through 2028, individuals who receive qualified overtime compensation may deduct the pay that exceeds their regular rate of pay (generally, the “half” portion of “time-and-a-half” compensation) that is required by the Fair Labor Standards Act.

Yep.

Although I claimed it anyway. Worst case scenario is that they catch it some time down the road and make me pay it back. I will have made more on that money than the IRS will charge me in interest.

I also think it is bullcrap that Carol at the local Home Depot can deduct her OT but I can't.

Or worse, that a 22.3 or full-time inside employee here at UPS, the same company I work for, can deduct their OT but I can't just because I drive.

You guys will probably be okay, as most government agencies like the IRS have been DOGE'd to the bare bones, so there won't be the resources available necessary to audit all the erroneous deductions made by UPS drivers this year.....unless AI takes over????

Well, he did dig deeper. And says we still qualify for a portion of it. As well as he has received memos from the IRS saying this is a transition year and the likelihood of an Audit being triggered by this is very unlikely.

But again that’s why I pay him the big bucks and I don’t do it myself.

For the record, this wasn’t any kind of windfall at all lol.

My guess is AI is exactly the plan. Most people hate talking to a government agency worker. Wait till they have to deal with AI. It will be hell.
