IBT Sues UPS for Breach of NMA

Such is life. Maybe the run of UPS being a safe career bet is over.

Anyway, the union wants low seniority guys gone, the ones close to retirement, they want to stay.

Higher pay higher dues.

W

Funny how the union has money for expensive when they might lose union dues via layoffs?

Hello, I'm retiring, and will be eligible for health care and pension. Take the cash!

Anybody else doesn't care about anything other than quitting.Never have I heard of the union trying to talk someone out of quitting.

Exactly

Dud the union say
@wally please don't retire?

Did they say anything about the Central States getting an extra $1000 a month if they retire during this contract

@bigunionguy am I wrong?

People not close to retiring quit all the time. Never do I recall union outrage.

Anyway, if the company does well, it will need new blood.

Many drivers retired under this current contract but before the buyout offers. Most if not all of us would have postponed retirement had we known $150k was soon to be available. The buyout was not negotiated and violates the contract. It is a separate agreement between employer and employee. It contradicts with the provisions of the contract by offering different terms of employment and different wages for employees under the same contract.

Retirees cannot file grievances but can be included in the remedy to current employee grievances.

So please, current drivers; file grievances regarding the buyouts and specify in the remedy requested: all drivers who retired under the current contract to be paid $150k.

Thanks brothers and sisters!

You did not retire under the current CBA. No provisions of the contract you retired under were changed mid-contract. The terms of employment and wages were changed mid contract and executed by an agreement outside of contractually negotiated terms between the employer and employee. Show us the money!!

Steward sent me this a little bit ago. Thought I'd post it here for you degenerates.

That was between the IBT and UPS. Plus the grievance process and/or NLRB process is still working its way through the proper channels. Members who retired prior to the buyout offer present a patently different legal argument and seek a different remedy than the union.

They chose to retire.

They chose to retire.

it is the equivalent of UPS changing the pension mid contract. I do not know if the buyout is an ERISA violation. but changing the pension mid contract sure would be.

Usually pension payouts are changed due to the health of the pension plan. Many many plans covers retired UPSERS

It's like you're saying "I was a preloader in 2109 and showed up to work on time every day until I quit, but then in 2020 UPS started offering 'show up on time' bonuses to preloaders. I should be entitled to show up on time bonuses for all those weeks in 2019. I don't work there anymore because I quit but please someone file a grievance asking UPS to pay me my bonus."

It's comically preposterous. Good luck and God speed.
