There is new language in art 37 that says if I am not going to be back in 8 hours on a day that I have been approved to be relieved from overtime, I will notify my management team by 1300. What happens if I lose track of time and don't send a DIAD message in until 1330 or if I don't send one in at all? Do I lose the right to grieve for penalty pay?

You never lose the right to grieve. You just give the company a stronger argument of why you shouldnt receive the contractual penalty.
