Buyout

I'm not. I wouldnt say screw them tho. Their union leadership already did that.

Rumor has it the company didn't want to honor seniority for the buyout.

I keep wondering HOW the union didnt see this coming. They have no spies? No informants? You can bet UPS does.
Another example of UPS playing chess, while the union plays checkers.

They did know that’s why the grievances were filed. People mistakenly believe the first one was allowed to happen. It also has a grievance on it and could be overturned. It was filed under national language and has to be heard at arbitration in May.

UPS isn’t playing chess they’re just doing whatever they want. That’s a problem in and of itself. They decided it was better to ask for forgiveness than to ask for permission. Of course everyone that signed those could be on the hook to pay them back if they’re found to be noncontractual or illegal. Thanks to the way UPS worded the language on the agreement that people signed.

Lol, they mad!!

They have a point tho. This is something the membership wants.

They could be mad, although none of them even know if they were going to get it. They’re not worried about the other people who’ve lost their jobs that aren’t drivers. There’s no guarantees anyone will be brought back from layoffs and layoffs won’t continue. And it can’t be stressed more that they’re asking the union to just look the other way on something that contractually the company was supposed to follow.

Perhaps they should send a letter to the company to negotiate these contractually and with good faith?

Ask yourself....how does the "Union" benefit from this monetarily?

Not at all.

Do you know if that language was put in the first buyout package about having to return the money?

I plan to put the money in a money market for a while. If I have to return it, I will.
But that will be a PR nightmare for UPS. All those poor, older drivers who were paid to retire and now UPS is demanding the money back..

Say 10,000 people were to take it.....I can't see them suing all those people to get their money back.

What legal grounds would constitute a lawsuit?

That's every fool's first comment, "I'm going to sue".

LOL

If people didn't return the buyout money? What could they do? Deduct it from pension payments?

Pension has nothing to do with UPS. They would have to sue you for it. Then you would have to contend with possible punitive damages or interest.

That's what I said but @bubblehead was questioning what I was talking about suing.

My pension is paid by UPS right now.

Lawsuits?

Yes lawsuits...I asked what if people didn't return the buyout money as per the agreement what recourse would UPS have? I said I doubt they(UPS)would sue everyone.

No, your pension is administered by the UPS/IBT Pension Fund and ran completely independent of UPS and the Teamsters,

....and subject to strict laws.

Whatever...back to the question.

I didn't read that close and have heard people claim they were going to sue the Union over not getting the buyout in the Central.

My bad.

That's a pretty dumb idea....sue the Teamsters....win.....pay your lawyer $50,000 of your $150,000 buyout.

Then that would be at risk potentially. Need a lawyer for sure.

Then that would be at risk potentially.

Apparently not.
